The law firm Jurvneshservice has successfully protected its client, a Bulgarian company Balkan Progetti Management dealing with supply of chemical raw materials for cosmetic and pharmacy, which claimed from a Ukrainian company Nechiporuk Transport Service recovery of indebtedness.
The arbitration clause agreed by the parties stated that any dispute or controversy had to be settled in a court of Kyiv. Such arbitration clause could not be performed and correspondingly the case had to be considered by a Ukrainian commercial court under the Commercial Procedural Court at the defendant location. The Bulgarian law had to be the governing.
Commercial court of Ternopil Region took a decision on its competence to consider the case and satisfied the relief sought by Balkan Progetti Management.

Anna Tsirat, a partner to Jurvnveshservice has successfully finished a range of administrative cases in favor of her client New World Grain Ukraine at the Kyiv courts (County Administrative Court of the city of Kyiv and Kyiv Appeal Administrative Court) this November. Dr. Tsirat has cancelled decisions of the tax authorities as to accrual of fines for almost of USD 1 million in total.
